Florida Bar, Legal Services, Attorneys, Lawyers

Fake attorneys, out of state attorneys, and foreign attorneys not licensed and admitted to practice law in Florida have plagued our community for decades. While these fake lawyers may advertise themselves as a cheaper alternative to licensed attorneys, their incompetence, lack of education, and inability to give knowledge based legal advise, act as a lawyer, and represent their clients in important court hearings result in numerous legal problems and higher costs. Because these individuals are not licensed to practice law, their clients often wind up loosing the money they paid and ultimately have to hire real attorneys to help them resolve the additional legal problems that these unlicensed, fake attorneys cause. To protect the public against the harm caused by unlicensed individuals practicing law the Unlicensed Practice of Law (UPL) program was established by the Supreme Court of Florida: https://www.floridabar.org/rules/upl/upl001/

Here’s what you can do to ensure that you are dealing with a real attorney:

1. Ask for the attorney’s FULL LEGAL NAME
2. Ask for the attorney’s Florida Bar Number

3. Then look them up in the Florida Bar’s Website: https://www.floridabar.org/directories/find-mbr/ or call: 1-850-561-5600

Make sure that the information on the attorney’s State Bar profile, Florida Bar number, picture, address, e-mail, and telephone numbers, match the information the attorney has given you before paying them or signing anything.

If they do not have a Florida Bar number or the information on the attorney’s Florida Bar profile, picture, address, e-mail, telephone numbers do not match the information the attorney has given you please call: 1-850-561-5600 and ask for the unlicensed practice of law offices and file a complaint against them. You can also file a complaint against them by visiting: https://www.floridabar.org/rules/upl/upl001/

Foreign Legal Consultants

The Florida Bar’s Foreign Legal Consultancy Rule allows a foreign attorney to advise clients ONLY on the laws of the country under which the attorney is admitted to practice. The Florida Bar’s Foreign Legal Consultancy Rule DOES NOT allow a foreign attorney to advise clients on the laws of the state of Florida if they are not licensed and admitted to practice law in Florida. To find out if a Foreign Legal Consultant is licensed and admitted to practice law in Florida look them up in the Florida Bar’s Website: https://www.floridabar.org/directories/find-mbr/

or call: 1-850-561-5600

Out of State Legal Consultants

Each state has its own Bar which regulates the admission of lawyers in that state. All State Bars maintain websites containing directories of all admitted lawyers where you can insert an individual’s name or State Bar Number to see if they are licensed. To find out if an Out of State Legal Consultant is licensed and admitted to practice law in Florida look them up in the Florida Bar’s Website: https://www.floridabar.org/directories/find-mbr/ or call: 1-850-561-5600

Unlicensed Practice of Law, To file a complaint against someone you believe is practicing law without a license

The Unlicensed Practice of Law (UPL) program was established by the Supreme Court of Florida to protect the public against harm caused by unlicensed individuals practicing law. The Supreme Court of Florida has given The Florida Bar the duty to investigate and take action against the unlicensed practice of law. Here you will find information on how to protect yourself against the unlicensed practice of law, how to file a complaint against someone you believe is practicing law without a license, and information about the Bar’s unlicensed practice of law offices and committees: https://www.floridabar.org/rules/upl/upl001/
